Terms of Service

These Terms of Service ("Terms") constitute a legally binding agreement between you ("User", "you", or "your") and Uniq Intercom ("Company", "we", "us", or "our") governing your access to and use of the Uniq Intercom mobile application, website, and all related services (collectively, the "Services").

PLEASE READ THESE TERMS CAREFULLY BEFORE USING THE SERVICES. BY DOWNLOADING, INSTALLING, CREATING AN ACCOUNT, OR OTHERWISE USING THE SERVICES, YOU ACKNOWLEDGE THAT YOU HAVE READ, UNDERSTOOD, AND AGREE TO BE BOUND BY THESE TERMS. IF YOU DO NOT AGREE TO THESE TERMS, DO NOT USE THE SERVICES.

1. Eligibility

The Services are intended for motorcycle riders who hold a valid driver's license. By using the Services, you represent and warrant that you are at least 18 years of age, that you hold a valid motorcycle or motor vehicle driver's license in your jurisdiction, and that you have the legal capacity to enter into this agreement. If you are using the Services on behalf of an organization, you represent that you have the authority to bind that organization to these Terms.

2. Description of Services

Uniq Intercom is a mobile application that provides real-time voice communication (intercom), live GPS map tracking, group tour management, crash detection, SOS emergency alerts, and related features for motorcycle riders. The Services require an active internet connection (cellular data or Wi-Fi) and are designed to work with Bluetooth helmet headsets of any brand.

Tour/group rooms are accessed via generic alphanumeric join codes. These codes are not user-specific — any person who obtains a valid code may join the corresponding room. The Company does not verify the identity of individuals who join tour rooms.

3. Account Registration

To use the Services, you must create an account using Apple Sign-In or Google Sign-In. You are responsible for:

Maintaining the confidentiality and security of your account credentials
All activities and actions that occur under your account
Providing accurate and complete information during registration and keeping it up to date
Notifying us immediately of any unauthorized use of your account

We are not liable for any loss or damage arising from unauthorized access to your account, whether or not you have notified us.

4. Acceptable Use

You agree not to:

Use the Services for any unlawful purpose or in violation of any applicable local, national, or international law or regulation
Harass, threaten, abuse, defame, stalk, or intimidate other users
Impersonate any person or entity, or falsely represent your affiliation with any person or entity
Attempt to gain unauthorized access to the Services, other user accounts, or any related systems or networks
Interfere with or disrupt the Services, servers, or networks connected to the Services
Reverse-engineer, decompile, disassemble, or otherwise attempt to derive the source code of the Services
Misuse the SOS emergency feature for non-emergency purposes
Share tour join codes publicly or with unintended recipients in a manner that compromises group safety
Use the Services while under the influence of alcohol, drugs, or any substance that impairs your ability to operate a vehicle safely
Distribute malicious content, spam, or viruses through the Services
Use automated scripts, bots, or other means to access the Services
Circumvent, disable, or otherwise interfere with any security or access-control features of the Services

5. Safety and Riding Disclaimer

IMPORTANT SAFETY NOTICE — PLEASE READ CAREFULLY:

MOTORCYCLE RIDING IS AN INHERENTLY DANGEROUS ACTIVITY THAT CARRIES A RISK OF SERIOUS INJURY, PERMANENT DISABILITY, OR DEATH. BY USING THE SERVICES, YOU ACKNOWLEDGE AND VOLUNTARILY ASSUME ALL RISKS ASSOCIATED WITH MOTORCYCLE RIDING, INCLUDING BUT NOT LIMITED TO RISKS ARISING FROM TRAFFIC CONDITIONS, WEATHER, ROAD HAZARDS, MECHANICAL FAILURES, AND THE ACTIONS OF OTHER ROAD USERS.

5.1 Not a Safety Device

The Services are communication and coordination tools. They are NOT safety devices, navigation systems, or substitutes for safe riding practices, proper protective gear, rider training, or professional emergency services. Features such as SOS, crash detection, and live location sharing are provided as convenience aids only and are not guaranteed to function in all conditions, including but not limited to areas with poor network coverage, extreme weather, device malfunction, or software errors.

5.2 Distraction Risk

The Services involve audio communication that may distract you while operating a motorcycle. You are solely responsible for maintaining full awareness of traffic, road conditions, and your surroundings at all times. Do not interact with the app's visual interface while riding. All tour and communication settings must be configured before you begin riding. The Services are designed for hands-free use only — you must not hold, touch, or visually interact with your device while operating a motorcycle or any vehicle.

5.3 Crash Detection Limitations

The crash detection feature relies on device accelerometer and gyroscope data and may produce false positives (alerting when no crash occurred) or false negatives (failing to detect an actual crash). Do not rely solely on this feature for emergency response. Always call emergency services (112, 911, or your local emergency number) directly in case of an accident.

5.4 No Guarantee of Communication

Audio and data connections may be interrupted, delayed, or unavailable due to network conditions, signal loss, server issues, Bluetooth interference, or other factors beyond our control. We do not guarantee uninterrupted, error-free, or secure communication and are not liable for any consequences arising from connection failures or communication delays.

5.5 Compliance with Laws

You agree to comply with all applicable traffic laws and regulations in your jurisdiction at all times, including laws governing the use of electronic communication devices while operating a motor vehicle. In many jurisdictions, interacting with a mobile device while riding is illegal. You are solely responsible for ensuring your use of the Services complies with all applicable laws.

5.6 Third-Party Hardware

The Services are designed to work with various Bluetooth helmet communication systems from any brand. We do not manufacture, endorse, certify, or guarantee compatibility with any specific hardware. We are not responsible for hardware malfunctions, audio quality issues, or any other problems arising from third-party equipment.

6. Tour Codes and Shared Access

Tour join codes are generic alphanumeric identifiers generated by the Services. These codes are not tied to specific user identities and grant access to any holder. When you create a tour and share the join code, you accept that:

Any person with the code may join your tour room without additional identity verification
You are solely responsible for distributing codes only to intended participants
The Company is not liable for unauthorized participants joining your tour due to code sharing
You may end a tour at any time to revoke access and create a new tour with a fresh code

7. Premium Subscription

Uniq Intercom may offer premium features through in-app subscriptions managed by Apple (App Store) or Google (Google Play) and processed by RevenueCat.

Payment is charged to your Apple ID or Google account upon confirmation of purchase
Subscriptions automatically renew unless auto-renew is turned off at least 24 hours before the end of the current billing period
You can manage and cancel subscriptions in your device's Settings (iOS: Apple ID → Subscriptions; Android: Google Play → Subscriptions)
No refunds are provided for unused portions of a subscription period, except as required by applicable law
Subscription prices may change; we will notify you of any price changes in advance
Free trial periods, if offered, will automatically convert to a paid subscription at the end of the trial unless cancelled

We reserve the right to modify, suspend, or discontinue premium features at any time. In the event of discontinuation, active subscribers will receive a pro-rated refund for the unused portion of their current billing period, or continued access until the end of the billing period, at our discretion.

8. User Content and Voice Communication

You retain ownership of any content you submit through the Services (profile information, feedback messages, tour names). By submitting content, you grant us a worldwide, non-exclusive, royalty-free, transferable license to use, reproduce, and display such content solely for the purpose of operating and improving the Services.

Voice Communication: By using the intercom and tour features, you consent to real-time audio transmission to all other participants in your tour group. Voice data is transmitted in real-time through our servers and is not recorded or stored by Uniq Intercom. You are solely responsible for the content of your voice communications. The Company is not liable for any offensive, harmful, or illegal content transmitted by users through the voice communication features.

Recording by Others: While we do not record voice communications, we cannot prevent other participants from recording conversations using their own devices. You acknowledge this possibility and agree that the Company is not responsible for any recordings made by third parties. In jurisdictions requiring all-party consent for recording, you are responsible for obtaining necessary consent before recording any communication.

9. Intellectual Property

The Services, including but not limited to the software, code, design, graphics, logos, trademarks, user interface, documentation, and all other content and materials, are the exclusive property of Uniq Intercom and are protected by intellectual property laws, including copyright, trademark, and trade secret laws. All rights not expressly granted herein are reserved.

You may not copy, modify, adapt, translate, distribute, reverse-engineer, decompile, disassemble, create derivative works from, or otherwise exploit any part of the Services without our prior written consent.

10. Assumption of Risk

BY USING THE SERVICES, YOU EXPRESSLY ACKNOWLEDGE AND AGREE THAT:

(A) YOUR USE OF THE SERVICES IS ENTIRELY AT YOUR OWN RISK;

(B) MOTORCYCLE RIDING IS INHERENTLY DANGEROUS AND YOU VOLUNTARILY ASSUME ALL RISKS ASSOCIATED WITH IT;

(C) THE COMPANY IS NOT RESPONSIBLE FOR ANY ACCIDENTS, INJURIES, DEATH, PROPERTY DAMAGE, OR ANY OTHER LOSSES ARISING FROM OR RELATED TO YOUR USE OF THE SERVICES OR YOUR RIDING ACTIVITIES;

(D) YOU HAVE MADE YOUR OWN INDEPENDENT ASSESSMENT OF THE RISKS INVOLVED IN USING THE SERVICES WHILE RIDING AND HAVE VOLUNTARILY CHOSEN TO ACCEPT THOSE RISKS;

(E) THE COMPANY MAKES NO REPRESENTATIONS OR WARRANTIES REGARDING THE SAFETY OR RELIABILITY OF THE SERVICES FOR USE DURING MOTORCYCLE RIDING OR ANY OTHER ACTIVITY.

11. Disclaimer of Warranties

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, THE SERVICES ARE PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS, IMPLIED, STATUTORY, OR OTHERWISE. THE COMPANY EXPRESSLY DISCLAIMS ALL IMPLIED WARRANTIES, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, NON-INFRINGEMENT, AND ACCURACY.

WITHOUT LIMITING THE FOREGOING, THE COMPANY DOES NOT WARRANT THAT:

THE SERVICES WILL BE UNINTERRUPTED, TIMELY, SECURE, OR ERROR-FREE;
THE RESULTS OBTAINED FROM THE USE OF THE SERVICES WILL BE ACCURATE OR RELIABLE;
THE QUALITY OF THE SERVICES WILL MEET YOUR EXPECTATIONS;
ANY ERRORS IN THE SERVICES WILL BE CORRECTED;
THE SERVICES WILL BE COMPATIBLE WITH YOUR DEVICE OR THIRD-PARTY HARDWARE;
VOICE COMMUNICATION WILL BE UNINTERRUPTED OR AVAILABLE IN ALL AREAS;
LOCATION DATA WILL BE ACCURATE AT ALL TIMES;
CRASH DETECTION OR SOS FEATURES WILL FUNCTION CORRECTLY IN ALL CIRCUMSTANCES.

12. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL THE COMPANY, ITS OWNER, OFFICERS, DIRECTORS, EMPLOYEES, AGENTS, LICENSORS, OR SERVICE PROVIDERS BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, PUNITIVE, OR EXEMPLARY DAMAGES, INCLUDING BUT NOT LIMITED TO DAMAGES FOR LOSS OF PROFITS, GOODWILL, USE, DATA, OR OTHER INTANGIBLE LOSSES, ARISING OUT OF OR IN CONNECTION WITH:

YOUR ACCESS TO, USE OF, OR INABILITY TO USE THE SERVICES;
ANY CONDUCT OR CONTENT OF ANY THIRD PARTY ON THE SERVICES;
ANY CONTENT OBTAINED FROM THE SERVICES;
UNAUTHORIZED ACCESS TO, USE OF, OR ALTERATION OF YOUR TRANSMISSIONS OR CONTENT;
ACCIDENTS, INJURIES, DEATH, OR PROPERTY DAMAGE OCCURRING DURING OR IN CONNECTION WITH MOTORCYCLE RIDING OR ANY OTHER ACTIVITY;
FAILURE OF CRASH DETECTION, SOS, OR ANY OTHER SAFETY-RELATED FEATURES;
INTERRUPTION OR FAILURE OF VOICE COMMUNICATION OR DATA CONNECTIONS;
INACCURATE OR UNAVAILABLE LOCATION DATA;
UNAUTHORIZED ACCESS TO YOUR TOUR ROOM VIA SHARED TOUR CODES;
ACTIONS OR OMISSIONS OF OTHER USERS OR TOUR PARTICIPANTS.

TO THE MAXIMUM EXTENT PERMITTED BY LAW, THE COMPANY'S TOTAL AGGREGATE LIABILITY ARISING OUT OF OR RELATING TO THESE TERMS OR THE SERVICES SHALL NOT EXCEED THE GREATER OF (A) THE AMOUNT YOU HAVE PAID TO THE COMPANY IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM, OR (B) ONE HUNDRED UNITED STATES DOLLARS (US$100.00).

THE FOREGOING LIMITATIONS SHALL APPLY EVEN IF THE COMPANY HAS BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES AND REGARDLESS OF WHETHER ANY REMEDY SET FORTH HEREIN FAILS OF ITS ESSENTIAL PURPOSE. SOME JURISDICTIONS DO NOT ALLOW THE EXCLUSION OR LIMITATION OF CERTAIN DAMAGES, SO SOME OF THE ABOVE LIMITATIONS MAY NOT APPLY TO YOU.

13. Indemnification

You agree to indemnify, defend, and hold harmless the Company, its owner, officers, directors, employees, agents, licensors, and service providers from and against any and all claims, liabilities, damages, losses, costs, and expenses (including reasonable attorneys' fees and legal costs) arising out of or in connection with:

Your use of or access to the Services
Your violation of these Terms or any applicable law or regulation
Your violation of any rights of a third party, including other users
Your negligence or willful misconduct
Any content you submit or transmit through the Services
Any accident, injury, death, or property damage related to your motorcycle riding or use of the Services
Claims by third parties who gained access to your tour via shared codes
Your failure to comply with traffic laws or safe riding practices while using the Services

This indemnification obligation shall survive the termination of these Terms and your use of the Services.

14. Termination

We reserve the right to suspend or terminate your account and access to the Services, in our sole discretion, at any time and for any or no reason, including but not limited to violation of these Terms, with or without prior notice. We shall not be liable to you or any third party for any suspension or termination of your account or access to the Services.

You may delete your account at any time through the app (Settings → Delete Account) or by contacting us at info@uniqintercom.com. Upon account deletion, your personal data will be handled in accordance with our Privacy Policy.

The following sections shall survive termination: Sections 5 (Safety), 10 (Assumption of Risk), 11 (Disclaimer), 12 (Limitation of Liability), 13 (Indemnification), 16 (Governing Law), and any other provisions that by their nature should survive.

15. Modifications to Terms and Services

We reserve the right to modify these Terms at any time. We will notify you of material changes through the app or by email. The "Last updated" date at the top indicates when these Terms were last revised. Your continued use of the Services after the effective date of any changes constitutes acceptance of the modified Terms. If you do not agree to the modified Terms, you must stop using the Services and delete your account.

We reserve the right to modify, suspend, or discontinue the Services (or any part thereof) at any time, temporarily or permanently, with or without notice. We shall not be liable to you or any third party for any modification, suspension, or discontinuation of the Services.

16. Governing Law and Dispute Resolution

These Terms shall be governed by and construed in accordance with the laws of the Republic of Turkey, without regard to its conflict of law provisions.

Any dispute, controversy, or claim arising out of or relating to these Terms or the Services shall be subject to the exclusive jurisdiction of the courts located in Istanbul, Turkey. You hereby consent to the personal jurisdiction of such courts and waive any objection to the convenience of such forum.

Notwithstanding the foregoing, we retain the right to seek injunctive or other equitable relief in any court of competent jurisdiction to prevent the actual or threatened infringement, misappropriation, or violation of our intellectual property rights or other proprietary rights.

17. Force Majeure

The Company shall not be liable for any failure or delay in performing its obligations under these Terms due to circumstances beyond its reasonable control, including but not limited to natural disasters, war, terrorism, riots, embargoes, acts of civil or military authorities, fire, floods, epidemics, pandemics, network infrastructure failures, power outages, telecommunications failures, internet service disruptions, cyberattacks, or any other force majeure event.

18. Severability

If any provision of these Terms is held to be invalid, illegal, or unenforceable by a court of competent jurisdiction, such provision shall be modified to the minimum extent necessary to make it valid, legal, and enforceable, or if modification is not possible, shall be severed from these Terms. The remaining provisions shall continue in full force and effect.

19. Waiver

The failure of the Company to enforce any right or provision of these Terms shall not constitute a waiver of such right or provision. Any waiver of any provision of these Terms will be effective only if in writing and signed by the Company.

20. Entire Agreement

These Terms, together with the Privacy Policy, constitute the entire agreement between you and the Company regarding the Services and supersede all prior or contemporaneous agreements, communications, representations, and understandings, whether oral or written.

21. Assignment

You may not assign or transfer these Terms or your rights hereunder, in whole or in part, without the prior written consent of the Company. The Company may assign or transfer these Terms, in whole or in part, without restriction and without your consent. Subject to the foregoing, these Terms shall be binding upon and inure to the benefit of the parties and their respective successors and assigns.

1. Uygunluk

Hizmetler, geçerli bir sürücü belgesine sahip motosiklet sürücülerine yöneliktir. Hizmetleri kullanarak, en az 18 yaşında olduğunuzu, bulunduğunuz yargı alanında geçerli bir motosiklet veya motorlu taşıt sürücü belgesine sahip olduğunuzu ve bu sözleşmeyi akdetmeye yönelik yasal ehliyetinizin bulunduğunu beyan ve taahhüt edersiniz. Hizmetleri bir kurum adına kullanıyorsanız, o kurumu bu Koşullarla bağlama yetkisine sahip olduğunuzu beyan edersiniz.

2. Hizmet Tanımı

Uniq Intercom, motosiklet sürücüleri için gerçek zamanlı sesli iletişim (intercom), canlı GPS harita takibi, grup tur yönetimi, kaza tespiti, SOS acil durum uyarıları ve ilgili özellikler sunan bir mobil uygulamadır. Hizmetler aktif bir internet bağlantısı (hücresel veri veya Wi-Fi) gerektirir ve her markadan Bluetooth kask kulaklığıyla çalışacak şekilde tasarlanmıştır.

Tur/grup odalarına genel alfanümerik katılım kodları aracılığıyla erişilir. Bu kodlar kullanıcıya özel değildir — geçerli bir kod elde eden herhangi bir kişi ilgili odaya katılabilir. Şirket, tur odalarına katılan kişilerin kimliğini doğrulamaz.

3. Hesap Oluşturma

Hizmetleri kullanmak için Apple Sign-In veya Google Sign-In ile bir hesap oluşturmanız gerekir. Aşağıdakilerden siz sorumlusunuz:

Hesap kimlik bilgilerinizin gizliliğini ve güvenliğini korumak
Hesabınız altında gerçekleşen tüm etkinlikler ve işlemler
Kayıt sırasında doğru ve eksiksiz bilgi sağlamak ve bunu güncel tutmak
Hesabınızın yetkisiz kullanımını derhal bize bildirmek

Bizi bilgilendirmiş olun ya da olmayın, hesabınıza yetkisiz erişimden kaynaklanan herhangi bir kayıp veya zarardan sorumlu değiliz.

4. Kabul Edilebilir Kullanım

Aşağıdakileri yapmamayı kabul edersiniz:

Hizmetleri herhangi bir yasa dışı amaçla veya geçerli herhangi bir yerel, ulusal ya da uluslararası yasa veya düzenlemeyi ihlal ederek kullanmak
Diğer kullanıcıları taciz etmek, tehdit etmek, kötü muamelede bulunmak, karalamak, takip etmek veya gözdağı vermek
Herhangi bir kişi ya da kurumu taklit etmek veya herhangi bir kişi ya da kurumla olan bağlantınızı yanlış beyan etmek
Hizmetlere, diğer kullanıcı hesaplarına veya ilgili herhangi bir sistem ya da ağa yetkisiz erişim sağlamaya çalışmak
Hizmetlere, sunuculara veya Hizmetlere bağlı ağlara müdahale etmek veya bunları aksatmak
Hizmetlerin kaynak kodunu tersine mühendislik yapmak, derlemesini çözmek, parçalarına ayırmak veya başka bir şekilde elde etmeye çalışmak
SOS acil durum özelliğini acil olmayan amaçlarla kötüye kullanmak
Tur katılım kodlarını, grup güvenliğini tehlikeye atacak şekilde kamuya açık olarak veya istenmeyen alıcılarla paylaşmak
Alkol, uyuşturucu veya bir aracı güvenli şekilde kullanma yeteneğinizi bozan herhangi bir maddenin etkisi altındayken Hizmetleri kullanmak
Hizmetler aracılığıyla kötü amaçlı içerik, spam veya virüs dağıtmak
Hizmetlere erişmek için otomatik komut dosyaları, botlar veya başka araçlar kullanmak
Hizmetlerin herhangi bir güvenlik veya erişim denetimi özelliğini atlatmak, devre dışı bırakmak veya bunlara başka bir şekilde müdahale etmek

5. Güvenlik ve Sürüş Sorumluluk Reddi

ÖNEMLİ GÜVENLİK BİLDİRİMİ — LÜTFEN DİKKATLİCE OKUYUNUZ:

MOTOSİKLET SÜRMEK, CİDDİ YARALANMA, KALICI SAKATLIK VEYA ÖLÜM RİSKİ TAŞIYAN, DOĞASI GEREĞİ TEHLİKELİ BİR FAALİYETTİR. HİZMETLERİ KULLANARAK, TRAFİK KOŞULLARI, HAVA DURUMU, YOL TEHLİKELERİ, MEKANİK ARIZALAR VE DİĞER YOL KULLANICILARININ EYLEMLERİNDEN KAYNAKLANAN RİSKLER DAHİL ANCAK BUNLARLA SINIRLI OLMAMAK ÜZERE, MOTOSİKLET SÜRMEYLE İLİŞKİLİ TÜM RİSKLERİ KABUL ETTİĞİNİZİ VE GÖNÜLLÜ OLARAK ÜSTLENDİĞİNİZİ BEYAN EDERSİNİZ.

5.1 Güvenlik Cihazı Değildir

Hizmetler, iletişim ve koordinasyon araçlarıdır. Güvenlik cihazı, navigasyon sistemi veya güvenli sürüş uygulamalarının, uygun koruyucu ekipmanın, sürücü eğitiminin ya da profesyonel acil durum hizmetlerinin yerini tutan araçlar DEĞİLDİR. SOS, kaza tespiti ve canlı konum paylaşımı gibi özellikler yalnızca kolaylık sağlayan yardımcılar olarak sunulmaktadır ve zayıf ağ kapsama alanına sahip bölgeler, aşırı hava koşulları, cihaz arızası veya yazılım hataları dahil ancak bunlarla sınırlı olmamak üzere tüm koşullarda çalışacağı garanti edilmez.

5.2 Dikkat Dağılması Riski

Hizmetler, bir motosikleti kullanırken dikkatinizi dağıtabilecek sesli iletişim içerir. Her zaman trafiğe, yol koşullarına ve çevrenize tam olarak dikkat etmekten yalnızca siz sorumlusunuz. Sürüş sırasında uygulamanın görsel arayüzüyle etkileşime girmeyiniz. Tüm tur ve iletişim ayarları, sürüşe başlamadan önce yapılandırılmalıdır. Hizmetler yalnızca eller serbest kullanım için tasarlanmıştır — bir motosikleti veya herhangi bir aracı kullanırken cihazınızı tutmamalı, ona dokunmamalı ya da görsel olarak onunla etkileşime girmemelisiniz.

5.3 Kaza Tespiti Sınırlamaları

Kaza tespiti özelliği, cihazın ivmeölçer ve jiroskop verilerine dayanır ve yanlış pozitifler (kaza olmadığı halde uyarı verme) veya yanlış negatifler (gerçek bir kazayı tespit edememe) üretebilir. Acil müdahale için yalnızca bu özelliğe güvenmeyiniz. Bir kaza durumunda her zaman doğrudan acil durum hizmetlerini (112, 911 veya yerel acil durum numaranız) arayınız.

5.4 İletişim Garantisi Yoktur

Ses ve veri bağlantıları; ağ koşulları, sinyal kaybı, sunucu sorunları, Bluetooth paraziti veya kontrolümüz dışındaki diğer etkenler nedeniyle kesilebilir, gecikebilir ya da kullanılamaz hale gelebilir. Kesintisiz, hatasız veya güvenli iletişim garanti etmiyoruz ve bağlantı arızalarından ya da iletişim gecikmelerinden kaynaklanan herhangi bir sonuçtan sorumlu değiliz.

5.5 Yasalara Uyum

Bulunduğunuz yargı alanındaki tüm geçerli trafik yasalarına ve düzenlemelerine her zaman uymayı kabul edersiniz; buna, bir motorlu taşıtı kullanırken elektronik iletişim cihazlarının kullanımını düzenleyen yasalar da dahildir. Birçok yargı alanında, sürüş sırasında bir mobil cihazla etkileşime girmek yasa dışıdır. Hizmetleri kullanımınızın tüm geçerli yasalara uygun olmasını sağlamaktan yalnızca siz sorumlusunuz.

5.6 Üçüncü Taraf Donanımı

Hizmetler, her markadan çeşitli Bluetooth kask iletişim sistemleriyle çalışacak şekilde tasarlanmıştır. Herhangi bir belirli donanımla uyumluluğu üretmiyor, onaylamıyor, sertifikalandırmıyor veya garanti etmiyoruz. Üçüncü taraf ekipmanlardan kaynaklanan donanım arızalarından, ses kalitesi sorunlarından veya diğer herhangi bir problemden sorumlu değiliz.

6. Tur Kodları ve Paylaşılan Erişim

Tur katılım kodları, Hizmetler tarafından oluşturulan genel alfanümerik tanımlayıcılardır. Bu kodlar belirli kullanıcı kimliklerine bağlı değildir ve koda sahip olan herkese erişim sağlar. Bir tur oluşturup katılım kodunu paylaştığınızda, aşağıdakileri kabul edersiniz:

Koda sahip herhangi bir kişi, ek bir kimlik doğrulaması olmaksızın tur odanıza katılabilir
Kodları yalnızca amaçlanan katılımcılara dağıtmaktan yalnızca siz sorumlusunuz
Şirket, kod paylaşımı nedeniyle turunuza katılan yetkisiz katılımcılardan sorumlu değildir
Erişimi iptal etmek ve yeni bir kodla yeni bir tur oluşturmak için bir turu istediğiniz zaman sonlandırabilirsiniz

7. Premium Abonelik

Uniq Intercom, Apple (App Store) veya Google (Google Play) tarafından yönetilen ve RevenueCat tarafından işlenen uygulama içi abonelikler aracılığıyla premium özellikler sunabilir.

Ödeme, satın alma onayının ardından Apple ID veya Google hesabınızdan tahsil edilir
Mevcut faturalandırma döneminin sonundan en az 24 saat önce otomatik yenileme kapatılmadığı sürece abonelikler otomatik olarak yenilenir
Abonelikleri cihazınızın Ayarlar bölümünden yönetebilir ve iptal edebilirsiniz (iOS: Apple ID → Abonelikler; Android: Google Play → Abonelikler)
Geçerli yasaların gerektirdiği durumlar dışında, bir abonelik döneminin kullanılmayan kısımları için geri ödeme yapılmaz
Abonelik fiyatları değişebilir; herhangi bir fiyat değişikliğini önceden size bildiririz
Sunulması halinde, ücretsiz deneme süreleri, iptal edilmediği takdirde deneme süresinin sonunda otomatik olarak ücretli aboneliğe dönüşür

Premium özellikleri herhangi bir zamanda değiştirme, askıya alma veya durdurma hakkını saklı tutarız. Durdurma durumunda, aktif aboneler, takdirimize bağlı olarak, mevcut faturalandırma dönemlerinin kullanılmayan kısmı için orantılı bir geri ödeme veya faturalandırma döneminin sonuna kadar devam eden erişim alacaktır.

8. Kullanıcı İçeriği ve Sesli İletişim

Hizmetler aracılığıyla gönderdiğiniz herhangi bir içeriğin (profil bilgileri, geri bildirim mesajları, tur adları) mülkiyeti sizde kalır. İçerik göndererek, bize yalnızca Hizmetleri işletmek ve geliştirmek amacıyla söz konusu içeriği kullanma, çoğaltma ve görüntüleme konusunda dünya çapında, münhasır olmayan, telifsiz, devredilebilir bir lisans verirsiniz.

Sesli İletişim: Intercom ve tur özelliklerini kullanarak, tur grubunuzdaki diğer tüm katılımcılara gerçek zamanlı ses iletimine rıza göstermiş olursunuz. Ses verileri, sunucularımız aracılığıyla gerçek zamanlı olarak iletilir ve Uniq Intercom tarafından kaydedilmez veya saklanmaz. Sesli iletişimlerinizin içeriğinden yalnızca siz sorumlusunuz. Şirket, kullanıcıların sesli iletişim özellikleri aracılığıyla ilettiği saldırgan, zararlı veya yasa dışı herhangi bir içerikten sorumlu değildir.

Başkaları Tarafından Kayıt: Sesli iletişimleri biz kaydetmesek de, diğer katılımcıların kendi cihazlarını kullanarak görüşmeleri kaydetmesini engelleyemeyiz. Bu olasılığı kabul eder ve Şirketin üçüncü taraflarca yapılan herhangi bir kayıttan sorumlu olmadığını kabul edersiniz. Kayıt için tüm tarafların rızasının gerekli olduğu yargı alanlarında, herhangi bir iletişimi kaydetmeden önce gerekli rızayı almaktan siz sorumlusunuz.

9. Fikri Mülkiyet

Yazılım, kod, tasarım, grafikler, logolar, ticari markalar, kullanıcı arayüzü, dokümantasyon ve diğer tüm içerik ve materyaller dahil ancak bunlarla sınırlı olmamak üzere Hizmetler, Uniq Intercom'un münhasır mülkiyetindedir ve telif hakkı, ticari marka ve ticari sır yasaları dahil olmak üzere fikri mülkiyet yasalarıyla korunmaktadır. Burada açıkça tanınmayan tüm haklar saklıdır.

Önceden yazılı iznimiz olmaksızın Hizmetlerin herhangi bir bölümünü kopyalayamaz, değiştiremez, uyarlayamaz, çeviremez, dağıtamaz, tersine mühendislik yapamaz, derlemesini çözemez, parçalarına ayıramaz, bunlardan türev eserler oluşturamaz veya başka bir şekilde kullanamazsınız.

10. Riskin Üstlenilmesi

HİZMETLERİ KULLANARAK, AŞAĞIDAKİLERİ AÇIKÇA KABUL VE BEYAN EDERSİNİZ:

(A) HİZMETLERİ KULLANIMINIZ TAMAMEN KENDİ RİSKİNİZ ALTINDADIR;

(B) MOTOSİKLET SÜRMEK DOĞASI GEREĞİ TEHLİKELİDİR VE BUNUNLA İLİŞKİLİ TÜM RİSKLERİ GÖNÜLLÜ OLARAK ÜSTLENİRSİNİZ;

(C) ŞİRKET, HİZMETLERİ KULLANIMINIZDAN VEYA SÜRÜŞ FAALİYETLERİNİZDEN KAYNAKLANAN YA DA BUNLARLA İLİŞKİLİ HERHANGİ BİR KAZA, YARALANMA, ÖLÜM, MADDİ HASAR VEYA DİĞER HERHANGİ BİR KAYIPTAN SORUMLU DEĞİLDİR;

(D) SÜRÜŞ SIRASINDA HİZMETLERİ KULLANMANIN İÇERDİĞİ RİSKLERİ KENDİ BAĞIMSIZ DEĞERLENDİRMENİZLE BELİRLEDİNİZ VE BU RİSKLERİ KABUL ETMEYİ GÖNÜLLÜ OLARAK SEÇTİNİZ;

(E) ŞİRKET, MOTOSİKLET SÜRÜŞÜ VEYA HERHANGİ BİR DİĞER FAALİYET SIRASINDA KULLANIM İÇİN HİZMETLERİN GÜVENLİĞİ VEYA GÜVENİLİRLİĞİ HAKKINDA HERHANGİ BİR BEYAN YA DA GARANTİDE BULUNMAZ.

11. Garantilerin Reddi

GEÇERLİ YASALARIN İZİN VERDİĞİ AZAMİ ÖLÇÜDE, HİZMETLER, AÇIK, ZIMNİ, YASAL VEYA BAŞKA TÜRLÜ HERHANGİ BİR GARANTİ OLMAKSIZIN "OLDUĞU GİBİ" VE "MEVCUT OLDUĞU ŞEKİLDE" SUNULMAKTADIR. ŞİRKET, TİCARETE ELVERİŞLİLİK, BELİRLİ BİR AMACA UYGUNLUK, MÜLKİYET, İHLAL ETMEME VE DOĞRULUK KONULARINDAKİ ZIMNİ GARANTİLER DAHİL ANCAK BUNLARLA SINIRLI OLMAMAK ÜZERE TÜM ZIMNİ GARANTİLERİ AÇIKÇA REDDEDER.

YUKARIDAKİLERİ SINIRLAMAKSIZIN, ŞİRKET AŞAĞIDAKİLERİ GARANTİ ETMEZ:

HİZMETLERİN KESİNTİSİZ, ZAMANINDA, GÜVENLİ VEYA HATASIZ OLACAĞINI;

12. Sorumluluğun Sınırlandırılması

HİZMETLERDEKİ HERHANGİ BİR ÜÇÜNCÜ TARAFIN DAVRANIŞI VEYA İÇERİĞİ;
HİZMETLERDEN ELDE EDİLEN HERHANGİ BİR İÇERİK;

YUKARIDAKİ SINIRLAMALAR, ŞİRKET BU TÜR ZARARLARIN OLASILIĞI HAKKINDA BİLGİLENDİRİLMİŞ OLSA BİLE VE BURADA BELİRTİLEN HERHANGİ BİR ÇÖZÜMÜN ASLİ AMACINI YERİNE GETİRMEKTE BAŞARISIZ OLUP OLMADIĞINA BAKILMAKSIZIN UYGULANACAKTIR. 13. Tazminat

Aşağıdakilerden kaynaklanan veya bunlarla bağlantılı olarak ortaya çıkan tüm talep, sorumluluk, zarar, kayıp, masraf ve giderlere (makul avukatlık ücretleri ve yasal masraflar dahil) karşı Şirketi, sahibini, yetkililerini, yöneticilerini, çalışanlarını, temsilcilerini, lisans verenlerini ve hizmet sağlayıcılarını tazmin etmeyi, savunmayı ve zarar görmelerini önlemeyi kabul edersiniz:

Hizmetleri kullanımınız veya bunlara erişiminiz
Bu Koşulları ya da geçerli herhangi bir yasa veya düzenlemeyi ihlal etmeniz
Diğer kullanıcılar dahil, üçüncü bir tarafın haklarını ihlal etmeniz
İhmaliniz veya kasıtlı kötü davranışınız
Hizmetler aracılığıyla gönderdiğiniz veya ilettiğiniz herhangi bir içerik
Motosiklet sürüşünüz veya Hizmetleri kullanımınızla ilgili herhangi bir kaza, yaralanma, ölüm veya maddi hasar
Paylaşılan kodlar aracılığıyla turunuza erişim sağlayan üçüncü tarafların talepleri
Hizmetleri kullanırken trafik yasalarına veya güvenli sürüş uygulamalarına uymamanız

Bu tazminat yükümlülüğü, bu Koşulların sona ermesinden ve Hizmetleri kullanımınızdan sonra da yürürlükte kalacaktır.

14. Fesih

Bu Koşulların ihlali dahil ancak bununla sınırlı olmamak üzere, herhangi bir nedenle ya da nedensiz olarak, önceden bildirimde bulunarak veya bulunmaksızın, tamamen kendi takdirimize bağlı olarak, herhangi bir zamanda hesabınızı ve Hizmetlere erişiminizi askıya alma veya feshetme hakkını saklı tutarız. Hesabınızın ya da Hizmetlere erişiminizin askıya alınması veya feshedilmesinden dolayı size veya herhangi bir üçüncü tarafa karşı sorumlu olmayacağız.

Hesabınızı istediğiniz zaman uygulama üzerinden (Ayarlar → Hesabı Sil) veya info@uniqintercom.com adresinden bizimle iletişime geçerek silebilirsiniz. Hesap silindikten sonra, kişisel verileriniz Gizlilik Politikamıza uygun olarak işlenecektir.

Aşağıdaki bölümler fesihten sonra da yürürlükte kalacaktır: Bölüm 5 (Güvenlik), 10 (Riskin Üstlenilmesi), 11 (Garantilerin Reddi), 12 (Sorumluluğun Sınırlandırılması), 13 (Tazminat), 16 (Geçerli Hukuk) ve nitelikleri gereği fesihten sonra da geçerli olması gereken diğer hükümler.

15. Koşullarda ve Hizmetlerde Değişiklikler

Bu Koşulları herhangi bir zamanda değiştirme hakkını saklı tutarız. Önemli değişiklikleri uygulama üzerinden veya e-posta yoluyla size bildiririz. Üstteki "Son güncelleme" tarihi, bu Koşulların en son ne zaman revize edildiğini gösterir. Herhangi bir değişikliğin yürürlüğe girme tarihinden sonra Hizmetleri kullanmaya devam etmeniz, değiştirilmiş Koşulları kabul ettiğiniz anlamına gelir. Değiştirilmiş Koşulları kabul etmiyorsanız, Hizmetleri kullanmayı bırakmalı ve hesabınızı silmelisiniz.

Hizmetleri (veya herhangi bir bölümünü) herhangi bir zamanda, geçici veya kalıcı olarak, bildirimde bulunarak ya da bulunmaksızın değiştirme, askıya alma veya durdurma hakkını saklı tutarız. Hizmetlerdeki herhangi bir değişiklik, askıya alma ya da durdurmadan dolayı size veya herhangi bir üçüncü tarafa karşı sorumlu olmayacağız.

16. Geçerli Hukuk ve Uyuşmazlıkların Çözümü

Bu Koşullar, kanunlar ihtilafı hükümleri dikkate alınmaksızın, Türkiye Cumhuriyeti yasalarına göre yönetilecek ve yorumlanacaktır.

Bu Koşullardan veya Hizmetlerden kaynaklanan ya da bunlarla ilgili herhangi bir uyuşmazlık, ihtilaf veya talep, İstanbul, Türkiye'de bulunan mahkemelerin münhasır yargı yetkisine tabi olacaktır. İşbu belgeyle, söz konusu mahkemelerin kişisel yargı yetkisini kabul eder ve bu mahkemenin uygunluğuna yönelik her türlü itirazdan feragat edersiniz.

Yukarıdakilere bakılmaksızın, fikri mülkiyet haklarımızın veya diğer mülkiyet haklarımızın fiili ya da tehdit altındaki ihlalini, kötüye kullanılmasını veya zarar görmesini önlemek amacıyla, yetkili herhangi bir mahkemede ihtiyati tedbir veya başka hakkaniyete dayalı çözümler talep etme hakkımızı saklı tutarız.

17. Mücbir Sebep

Şirket; doğal afetler, savaş, terörizm, ayaklanmalar, ambargolar, sivil veya askeri makamların eylemleri, yangın, sel, salgın hastalıklar, pandemiler, ağ altyapısı arızaları, elektrik kesintileri, telekomünikasyon arızaları, internet hizmeti kesintileri, siber saldırılar veya başka herhangi bir mücbir sebep olayı dahil ancak bunlarla sınırlı olmamak üzere, makul kontrolü dışındaki koşullar nedeniyle bu Koşullar kapsamındaki yükümlülüklerini yerine getirmemekten ya da gecikmesinden sorumlu olmayacaktır.

18. Bölünebilirlik

Bu Koşulların herhangi bir hükmünün, yetkili bir mahkeme tarafından geçersiz, yasa dışı veya uygulanamaz bulunması halinde, söz konusu hüküm onu geçerli, yasal ve uygulanabilir kılmak için gereken asgari ölçüde değiştirilecek ya da değişiklik mümkün değilse bu Koşullardan ayrılacaktır. Kalan hükümler tam olarak yürürlükte ve etkili kalmaya devam edecektir.

19. Feragat

Şirketin bu Koşulların herhangi bir hakkını ya da hükmünü uygulamaması, söz konusu haktan veya hükümden feragat anlamına gelmeyecektir. Bu Koşulların herhangi bir hükmünden feragat, yalnızca yazılı olması ve Şirket tarafından imzalanması halinde geçerli olacaktır.

20. Sözleşmenin Bütünlüğü

Bu Koşullar, Gizlilik Politikası ile birlikte, Hizmetlerle ilgili olarak sizinle Şirket arasındaki sözleşmenin tamamını oluşturur ve sözlü ya da yazılı, önceki veya eş zamanlı tüm anlaşmaların, iletişimlerin, beyanların ve mutabakatların yerine geçer.

21. Devir

Şirketin önceden yazılı izni olmaksızın, bu Koşulları veya bunlar kapsamındaki haklarınızı tamamen ya da kısmen devredemez veya aktaramazsınız. Şirket, bu Koşulları tamamen veya kısmen, herhangi bir kısıtlama olmaksızın ve sizin izniniz olmadan devredebilir ya da aktarabilir. Yukarıdakilere tabi olarak, bu Koşullar taraflar ve onların ilgili halefleri ile devralanları için bağlayıcı olacak ve onların yararına olacaktır.

Estos Terminos de Servicio ("Terminos") constituyen un acuerdo legalmente vinculante entre usted ("Usuario", "usted" o "su") y Uniq Intercom ("Empresa", "nosotros" o "nuestro") que rige su acceso y uso de la aplicacion movil Uniq Intercom, el sitio web y todos los servicios relacionados (colectivamente, los "Servicios").

LEA DETENIDAMENTE ESTOS TERMINOS ANTES DE UTILIZAR LOS SERVICIOS. AL DESCARGAR, INSTALAR, CREAR UNA CUENTA O UTILIZAR DE CUALQUIER OTRA FORMA LOS SERVICIOS, USTED RECONOCE QUE HA LEIDO, COMPRENDIDO Y ACEPTA QUEDAR VINCULADO POR ESTOS TERMINOS. 1. Elegibilidad

Los Servicios estan destinados a motociclistas que posean una licencia de conducir valida. Al utilizar los Servicios, usted declara y garantiza que tiene al menos 18 anos de edad, que posee una licencia de conducir de motocicleta o vehiculo motorizado valida en su jurisdiccion y que tiene la capacidad legal para celebrar este acuerdo. Si utiliza los Servicios en nombre de una organizacion, usted declara que tiene la autoridad para vincular a dicha organizacion a estos Terminos.

2. Descripcion de los Servicios

Uniq Intercom es una aplicacion movil que proporciona comunicacion de voz en tiempo real (intercomunicador), seguimiento GPS en vivo en el mapa, gestion de recorridos en grupo, deteccion de accidentes, alertas de emergencia SOS y funciones relacionadas para motociclistas. Los Servicios requieren una conexion activa a Internet (datos moviles o Wi-Fi) y estan disenados para funcionar con auriculares Bluetooth de casco de cualquier marca.

Las salas de recorrido/grupo se acceden mediante codigos de union alfanumericos genericos. Estos codigos no son especificos del usuario; cualquier persona que obtenga un codigo valido puede unirse a la sala correspondiente. La Empresa no verifica la identidad de las personas que se unen a las salas de recorrido.

3. Registro de Cuenta

Para utilizar los Servicios, debe crear una cuenta utilizando Apple Sign-In o Google Sign-In. Usted es responsable de:

Mantener la confidencialidad y seguridad de las credenciales de su cuenta
Todas las actividades y acciones que ocurran bajo su cuenta
Proporcionar informacion precisa y completa durante el registro y mantenerla actualizada
Notificarnos inmediatamente de cualquier uso no autorizado de su cuenta

No somos responsables de ninguna perdida o dano derivado del acceso no autorizado a su cuenta, independientemente de si nos ha notificado o no.

4. Uso Aceptable

Usted acepta no:

Utilizar los Servicios para cualquier proposito ilegal o en violacion de cualquier ley o regulacion local, nacional o internacional aplicable
Acosar, amenazar, abusar, difamar, acechar o intimidar a otros usuarios
Suplantar a cualquier persona o entidad, o declarar falsamente su afiliacion con cualquier persona o entidad
Intentar obtener acceso no autorizado a los Servicios, otras cuentas de usuario o cualquier sistema o red relacionados
Interferir con o interrumpir los Servicios, servidores o redes conectados a los Servicios
Realizar ingenieria inversa, descompilar, desensamblar o intentar derivar de otra manera el codigo fuente de los Servicios
Hacer uso indebido de la funcion de emergencia SOS para propositos no urgentes
Compartir codigos de union de recorrido publicamente o con destinatarios no previstos de manera que comprometa la seguridad del grupo
Utilizar los Servicios bajo la influencia del alcohol, drogas o cualquier sustancia que deteriore su capacidad para operar un vehiculo de forma segura
Distribuir contenido malicioso, spam o virus a traves de los Servicios
Utilizar scripts automatizados, bots u otros medios para acceder a los Servicios
Eludir, desactivar o interferir de cualquier otra forma con las funciones de seguridad o control de acceso de los Servicios

5. Exencion de Responsabilidad sobre Seguridad y Conduccion

AVISO DE SEGURIDAD IMPORTANTE — LEA DETENIDAMENTE:

LA CONDUCCION DE MOTOCICLETAS ES UNA ACTIVIDAD INHERENTEMENTE PELIGROSA QUE CONLLEVA RIESGO DE LESIONES GRAVES, DISCAPACIDAD PERMANENTE O MUERTE. AL UTILIZAR LOS SERVICIOS, USTED RECONOCE Y ASUME VOLUNTARIAMENTE TODOS LOS RIESGOS ASOCIADOS CON LA CONDUCCION DE MOTOCICLETAS, INCLUYENDO PERO NO LIMITADO A RIESGOS DERIVADOS DE CONDICIONES DE TRAFICO, CLIMA, PELIGROS EN LA CARRETERA, FALLAS MECANICAS Y ACCIONES DE OTROS USUARIOS DE LA VIA.

5.1 No es un Dispositivo de Seguridad

Los Servicios son herramientas de comunicacion y coordinacion. NO son dispositivos de seguridad, sistemas de navegacion ni sustitutos de practicas de conduccion segura, equipo de proteccion adecuado, formacion de conductores o servicios de emergencia profesionales. Funciones como SOS, deteccion de accidentes y ubicacion en vivo se proporcionan unicamente como ayudas de conveniencia y no se garantiza su funcionamiento en todas las condiciones, incluyendo pero no limitado a areas con cobertura de red deficiente, clima extremo, mal funcionamiento del dispositivo o errores de software.

5.2 Riesgo de Distraccion

Los Servicios implican comunicacion de audio que puede distraerle mientras opera una motocicleta. Usted es el unico responsable de mantener plena conciencia del trafico, las condiciones de la carretera y su entorno en todo momento. No interactue con la interfaz visual de la aplicacion mientras conduce. Todas las configuraciones de recorrido y comunicacion deben configurarse antes de comenzar a conducir. Los Servicios estan disenados unicamente para uso con manos libres; no debe sostener, tocar ni interactuar visualmente con su dispositivo mientras opera una motocicleta o cualquier vehiculo.

5.3 Limitaciones de la Deteccion de Accidentes

La funcion de deteccion de accidentes se basa en datos del acelerometro y giroscopio del dispositivo y puede producir falsos positivos (alertar cuando no ha ocurrido un accidente) o falsos negativos (no detectar un accidente real). No confie unicamente en esta funcion para la respuesta de emergencia. Llame siempre directamente a los servicios de emergencia (112, 911 o su numero de emergencia local) en caso de accidente.

5.4 Sin Garantia de Comunicacion

Las conexiones de audio y datos pueden interrumpirse, retrasarse o no estar disponibles debido a condiciones de red, perdida de senal, problemas del servidor, interferencia Bluetooth u otros factores fuera de nuestro control. No garantizamos comunicacion ininterrumpida, libre de errores o segura y no somos responsables de las consecuencias derivadas de fallos de conexion o retrasos en la comunicacion.

5.5 Cumplimiento de las Leyes

Usted acepta cumplir con todas las leyes y regulaciones de trafico aplicables en su jurisdiccion en todo momento, incluidas las leyes que rigen el uso de dispositivos de comunicacion electronica mientras opera un vehiculo motorizado. En muchas jurisdicciones, interactuar con un dispositivo movil mientras conduce es ilegal. Usted es el unico responsable de garantizar que su uso de los Servicios cumpla con todas las leyes aplicables.

5.6 Hardware de Terceros

Los Servicios estan disenados para funcionar con diversos sistemas de comunicacion Bluetooth para casco de cualquier marca. No fabricamos, respaldamos, certificamos ni garantizamos la compatibilidad con ningun hardware especifico. No somos responsables de mal funcionamiento del hardware, problemas de calidad de audio ni cualquier otro problema derivado de equipos de terceros.

6. Codigos de Recorrido y Acceso Compartido

Los codigos de union de recorrido son identificadores alfanumericos genericos generados por los Servicios. Estos codigos no estan vinculados a identidades de usuario especificas y otorgan acceso a cualquier titular. Al crear un recorrido y compartir el codigo de union, usted acepta que:

Cualquier persona con el codigo puede unirse a su sala de recorrido sin verificacion de identidad adicional
Usted es el unico responsable de distribuir los codigos solo a los participantes previstos
La Empresa no es responsable de los participantes no autorizados que se unan a su recorrido debido al intercambio de codigos
Puede finalizar un recorrido en cualquier momento para revocar el acceso y crear un nuevo recorrido con un codigo nuevo

7. Suscripcion Premium

Uniq Intercom puede ofrecer funciones premium a traves de suscripciones dentro de la aplicacion gestionadas por Apple (App Store) o Google (Google Play) y procesadas por RevenueCat.

El pago se carga a su Apple ID o cuenta de Google tras la confirmacion de la compra
Las suscripciones se renuevan automaticamente a menos que la renovacion automatica se desactive al menos 24 horas antes del final del periodo de facturacion actual
Puede gestionar y cancelar suscripciones en los Ajustes de su dispositivo (iOS: Apple ID → Suscripciones; Android: Google Play → Suscripciones)
No se proporcionan reembolsos por porciones no utilizadas de un periodo de suscripcion, excepto cuando lo exija la ley aplicable
Los precios de suscripcion pueden cambiar; le notificaremos cualquier cambio de precio con antelacion
Los periodos de prueba gratuita, si se ofrecen, se convertiran automaticamente en una suscripcion de pago al final de la prueba a menos que se cancelen

Nos reservamos el derecho de modificar, suspender o descontinuar las funciones premium en cualquier momento. En caso de descontinuacion, los suscriptores activos recibiran un reembolso prorrateado por la porcion no utilizada de su periodo de facturacion actual, o acceso continuo hasta el final del periodo de facturacion, a nuestra discrecion.

8. Contenido del Usuario y Comunicacion de Voz

Usted conserva la propiedad de cualquier contenido que envie a traves de los Servicios (informacion de perfil, mensajes de retroalimentacion, nombres de recorrido). Al enviar contenido, nos otorga una licencia mundial, no exclusiva, libre de regalias y transferible para usar, reproducir y mostrar dicho contenido unicamente con el proposito de operar y mejorar los Servicios.

Comunicacion de Voz: Al utilizar las funciones de intercomunicador y recorrido, usted consiente la transmision de audio en tiempo real a todos los demas participantes de su grupo de recorrido. Los datos de voz se transmiten en tiempo real a traves de nuestros servidores y no son grabados ni almacenados por Uniq Intercom. Usted es el unico responsable del contenido de sus comunicaciones de voz. La Empresa no es responsable de ningun contenido ofensivo, danino o ilegal transmitido por los usuarios a traves de las funciones de comunicacion de voz.

Grabacion por Terceros: Aunque no grabamos las comunicaciones de voz, no podemos evitar que otros participantes graben conversaciones utilizando sus propios dispositivos. Usted reconoce esta posibilidad y acepta que la Empresa no es responsable de ninguna grabacion realizada por terceros. En jurisdicciones que requieren el consentimiento de todas las partes para la grabacion, usted es responsable de obtener el consentimiento necesario antes de grabar cualquier comunicacion.

9. Propiedad Intelectual

Los Servicios, incluyendo pero no limitado al software, codigo, diseno, graficos, logotipos, marcas comerciales, interfaz de usuario, documentacion y todos los demas contenidos y materiales, son propiedad exclusiva de Uniq Intercom y estan protegidos por las leyes de propiedad intelectual, incluidas las leyes de derechos de autor, marcas comerciales y secretos comerciales. Todos los derechos no otorgados expresamente en este documento quedan reservados.

No puede copiar, modificar, adaptar, traducir, distribuir, realizar ingenieria inversa, descompilar, desensamblar, crear obras derivadas de, ni explotar de otra manera ninguna parte de los Servicios sin nuestro consentimiento previo por escrito.

10. Asuncion de Riesgo

AL UTILIZAR LOS SERVICIOS, USTED RECONOCE Y ACEPTA EXPRESAMENTE QUE:

(A) SU USO DE LOS SERVICIOS ES ENTERAMENTE BAJO SU PROPIO RIESGO;

(B) LA CONDUCCION DE MOTOCICLETAS ES INHERENTEMENTE PELIGROSA Y USTED ASUME VOLUNTARIAMENTE TODOS LOS RIESGOS ASOCIADOS;

(C) LA EMPRESA NO ES RESPONSABLE DE NINGUN ACCIDENTE, LESION, MUERTE, DANO A LA PROPIEDAD NI NINGUNA OTRA PERDIDA DERIVADA DE O RELACIONADA CON SU USO DE LOS SERVICIOS O SUS ACTIVIDADES DE CONDUCCION;

(D) USTED HA REALIZADO SU PROPIA EVALUACION INDEPENDIENTE DE LOS RIESGOS INVOLUCRADOS EN EL USO DE LOS SERVICIOS MIENTRAS CONDUCE Y HA ELEGIDO VOLUNTARIAMENTE ACEPTAR ESOS RIESGOS;

(E) LA EMPRESA NO HACE NINGUNA REPRESENTACION NI GARANTIA CON RESPECTO A LA SEGURIDAD O FIABILIDAD DE LOS SERVICIOS PARA SU USO DURANTE LA CONDUCCION DE MOTOCICLETAS O CUALQUIER OTRA ACTIVIDAD.

11. Exencion de Garantias

EN LA MAXIMA MEDIDA PERMITIDA POR LA LEY APLICABLE, LOS SERVICIOS SE PROPORCIONAN "TAL CUAL" Y "SEGUN DISPONIBILIDAD" SIN GARANTIAS DE NINGUN TIPO, YA SEAN EXPRESAS, IMPLICITAS, LEGALES O DE OTRO TIPO. LA EMPRESA RENUNCIA EXPRESAMENTE A TODAS LAS GARANTIAS IMPLICITAS, INCLUYENDO PERO NO LIMITADO A GARANTIAS IMPLICITAS DE COMERCIABILIDAD, IDONEIDAD PARA UN PROPOSITO PARTICULAR, TITULO, NO INFRACCION Y EXACTITUD.

SIN LIMITAR LO ANTERIOR, LA EMPRESA NO GARANTIZA QUE:

LOS SERVICIOS SEAN ININTERRUMPIDOS, OPORTUNOS, SEGUROS O LIBRES DE ERRORES;
LOS RESULTADOS OBTENIDOS DEL USO DE LOS SERVICIOS SEAN PRECISOS O FIABLES;
LA CALIDAD DE LOS SERVICIOS CUMPLA CON SUS EXPECTATIVAS;
CUALQUIER ERROR EN LOS SERVICIOS SEA CORREGIDO;
LOS SERVICIOS SEAN COMPATIBLES CON SU DISPOSITIVO O HARDWARE DE TERCEROS;
LA COMUNICACION DE VOZ SEA ININTERRUMPIDA O ESTE DISPONIBLE EN TODAS LAS AREAS;
LOS DATOS DE UBICACION SEAN PRECISOS EN TODO MOMENTO;
LA DETECCION DE ACCIDENTES O LAS FUNCIONES SOS FUNCIONEN CORRECTAMENTE EN TODAS LAS CIRCUNSTANCIAS.

12. Limitacion de Responsabilidad

EN LA MAXIMA MEDIDA PERMITIDA POR LA LEY APLICABLE, EN NINGUN CASO LA EMPRESA, SU PROPIETARIO, FUNCIONARIOS, DIRECTORES, EMPLEADOS, AGENTES, LICENCIANTES O PROVEEDORES DE SERVICIOS SERAN RESPONSABLES DE DANOS INDIRECTOS, INCIDENTALES, ESPECIALES, CONSECUENTES, PUNITIVOS O EJEMPLARES, INCLUYENDO PERO NO LIMITADO A DANOS POR PERDIDA DE BENEFICIOS, FONDO DE COMERCIO, USO, DATOS U OTRAS PERDIDAS INTANGIBLES, DERIVADOS DE O EN CONEXION CON:

SU ACCESO A, USO DE O INCAPACIDAD PARA USAR LOS SERVICIOS;
CUALQUIER CONDUCTA O CONTENIDO DE CUALQUIER TERCERO EN LOS SERVICIOS;
CUALQUIER CONTENIDO OBTENIDO DE LOS SERVICIOS;
ACCESO NO AUTORIZADO A, USO DE O ALTERACION DE SUS TRANSMISIONES O CONTENIDO;
ACCIDENTES, LESIONES, MUERTE O DANOS A LA PROPIEDAD QUE OCURRAN DURANTE O EN CONEXION CON LA CONDUCCION DE MOTOCICLETAS O CUALQUIER OTRA ACTIVIDAD;
FALLO DE LA DETECCION DE ACCIDENTES, SOS O CUALQUIER OTRA FUNCION RELACIONADA CON LA SEGURIDAD;
INTERRUPCION O FALLO DE LA COMUNICACION DE VOZ O CONEXIONES DE DATOS;
DATOS DE UBICACION INEXACTOS O NO DISPONIBLES;
ACCESO NO AUTORIZADO A SU SALA DE RECORRIDO A TRAVES DE CODIGOS DE RECORRIDO COMPARTIDOS;
ACCIONES U OMISIONES DE OTROS USUARIOS O PARTICIPANTES DEL RECORRIDO.

EN LA MAXIMA MEDIDA PERMITIDA POR LA LEY, LA RESPONSABILIDAD TOTAL ACUMULADA DE LA EMPRESA DERIVADA DE O RELACIONADA CON ESTOS TERMINOS O LOS SERVICIOS NO EXCEDERA EL MAYOR DE (A) LA CANTIDAD QUE USTED HAYA PAGADO A LA EMPRESA EN LOS DOCE (12) MESES ANTERIORES A LA RECLAMACION, O (B) CIEN DOLARES ESTADOUNIDENSES (US$100,00).

LAS LIMITACIONES ANTERIORES SE APLICARAN INCLUSO SI LA EMPRESA HA SIDO INFORMADA DE LA POSIBILIDAD DE DICHOS DANOS E INDEPENDIENTEMENTE DE SI CUALQUIER RECURSO ESTABLECIDO EN ESTE DOCUMENTO NO CUMPLE SU PROPOSITO ESENCIAL. ALGUNAS JURISDICCIONES NO PERMITEN LA EXCLUSION O LIMITACION DE CIERTOS DANOS, POR LO QUE ALGUNAS DE LAS LIMITACIONES ANTERIORES PUEDEN NO APLICARSE A USTED.

13. Indemnizacion

Usted acepta indemnizar, defender y mantener indemne a la Empresa, su propietario, funcionarios, directores, empleados, agentes, licenciantes y proveedores de servicios de y contra todas y cada una de las reclamaciones, responsabilidades, danos, perdidas, costos y gastos (incluidos honorarios razonables de abogados y costos legales) derivados de o en conexion con:

Su uso de o acceso a los Servicios
Su violacion de estos Terminos o de cualquier ley o regulacion aplicable
Su violacion de cualquier derecho de un tercero, incluidos otros usuarios
Su negligencia o conducta dolosa
Cualquier contenido que envie o transmita a traves de los Servicios
Cualquier accidente, lesion, muerte o dano a la propiedad relacionado con su conduccion de motocicleta o uso de los Servicios
Reclamaciones de terceros que obtuvieron acceso a su recorrido mediante codigos compartidos
Su incumplimiento de las leyes de trafico o practicas de conduccion segura mientras utiliza los Servicios

Esta obligacion de indemnizacion sobrevivira a la terminacion de estos Terminos y su uso de los Servicios.

14. Terminacion

Nos reservamos el derecho de suspender o cancelar su cuenta y acceso a los Servicios, a nuestra entera discrecion, en cualquier momento y por cualquier motivo o sin motivo, incluyendo pero no limitado a la violacion de estos Terminos, con o sin previo aviso. No seremos responsables ante usted ni ante ningun tercero por la suspension o terminacion de su cuenta o acceso a los Servicios.

Puede eliminar su cuenta en cualquier momento a traves de la aplicacion (Ajustes → Eliminar Cuenta) o contactandonos en info@uniqintercom.com. Tras la eliminacion de la cuenta, sus datos personales se manejaran de acuerdo con nuestra Politica de Privacidad.

Las siguientes secciones sobreviviran a la terminacion: Secciones 5 (Seguridad), 10 (Asuncion de Riesgo), 11 (Exencion de Garantias), 12 (Limitacion de Responsabilidad), 13 (Indemnizacion), 16 (Ley Aplicable) y cualquier otra disposicion que por su naturaleza deba sobrevivir.

15. Modificaciones a los Terminos y Servicios

Nos reservamos el derecho de modificar estos Terminos en cualquier momento. Le notificaremos los cambios sustanciales a traves de la aplicacion o por correo electronico. La fecha de "Ultima actualizacion" en la parte superior indica cuando se revisaron estos Terminos por ultima vez. Su uso continuado de los Servicios despues de la fecha de entrada en vigor de cualquier cambio constituye la aceptacion de los Terminos modificados. Si no esta de acuerdo con los Terminos modificados, debe dejar de utilizar los Servicios y eliminar su cuenta.

Nos reservamos el derecho de modificar, suspender o descontinuar los Servicios (o cualquier parte de ellos) en cualquier momento, temporal o permanentemente, con o sin previo aviso. No seremos responsables ante usted ni ante ningun tercero por cualquier modificacion, suspension o descontinuacion de los Servicios.

16. Ley Aplicable y Resolucion de Disputas

Estos Terminos se regiran e interpretaran de acuerdo con las leyes de la Republica de Turquia, sin tener en cuenta sus disposiciones sobre conflictos de leyes.

Cualquier disputa, controversia o reclamacion derivada de o relacionada con estos Terminos o los Servicios estara sujeta a la jurisdiccion exclusiva de los tribunales ubicados en Estambul, Turquia. Usted consiente la jurisdiccion personal de dichos tribunales y renuncia a cualquier objecion sobre la conveniencia de dicho foro.

Sin perjuicio de lo anterior, nos reservamos el derecho de solicitar medidas cautelares u otro recurso equitativo ante cualquier tribunal de jurisdiccion competente para prevenir la infraccion, apropiacion indebida o violacion real o amenazada de nuestros derechos de propiedad intelectual u otros derechos de propiedad.

17. Fuerza Mayor

La Empresa no sera responsable de ningun incumplimiento o retraso en el cumplimiento de sus obligaciones en virtud de estos Terminos debido a circunstancias fuera de su control razonable, incluyendo pero no limitado a desastres naturales, guerra, terrorismo, disturbios, embargos, actos de autoridades civiles o militares, incendios, inundaciones, epidemias, pandemias, fallos de infraestructura de red, cortes de energia, fallos de telecomunicaciones, interrupciones del servicio de Internet, ciberataques o cualquier otro evento de fuerza mayor.

18. Divisibilidad

Si cualquier disposicion de estos Terminos es considerada invalida, ilegal o inaplicable por un tribunal de jurisdiccion competente, dicha disposicion sera modificada en la minima medida necesaria para hacerla valida, legal y aplicable, o si la modificacion no es posible, sera separada de estos Terminos. Las disposiciones restantes continuaran en pleno vigor y efecto.

19. Renuncia

El hecho de que la Empresa no haga cumplir cualquier derecho o disposicion de estos Terminos no constituira una renuncia a dicho derecho o disposicion. Cualquier renuncia a cualquier disposicion de estos Terminos solo sera efectiva si es por escrito y esta firmada por la Empresa.

20. Acuerdo Completo

Estos Terminos, junto con la Politica de Privacidad, constituyen el acuerdo completo entre usted y la Empresa con respecto a los Servicios y reemplazan todos los acuerdos, comunicaciones, representaciones y entendimientos anteriores o contemporaneos, ya sean orales o escritos.

21. Cesion

No puede ceder ni transferir estos Terminos ni sus derechos en virtud de los mismos, en su totalidad o en parte, sin el consentimiento previo por escrito de la Empresa. La Empresa puede ceder o transferir estos Terminos, en su totalidad o en parte, sin restriccion y sin su consentimiento. Con sujecion a lo anterior, estos Terminos seran vinculantes y redundaran en beneficio de las partes y sus respectivos sucesores y cesionarios.
